Emerald Advisory GmbH, a Frankfurt-based consulting firm in the real estate debt and credit servicing segment, has filed a lawsuit against the Emerald Fund SCA SICAV-FIS, trading under the name “Marshall Bridge Fund”. The proceedings are pending before a German regional court.

The Emerald Fund SCA SICAV-FIS is a Luxembourg-based real estate finance fund specialising in short-term bridge financing through the Marshall Bridge Fund sub-fund. Emerald Advisory has historically acted operationally for the fund as part of a comprehensive servicing and management mandate.

The subject of the lawsuit are outstanding claims arising from the cooperation between the parties. The parties involved do not currently comment on the further background of the proceedings.

Emerald Advisory specialises in the management of complex real estate financing, the servicing of non-performing loans as well as structured work-out and liquidation processes. The company was involved in the operational management of an extensive loan portfolio over a longer period of time, acting in close coordination with the responsible decision-makers at fund level.

Emerald Advisory was also involved as an advisor at fund level as part of the cooperation and was listed as one of the General Partner’s advisors in the fund’s public image. “After careful consideration, we have decided to assert our claims in court. We do not currently comment on any governance or compliance-related issues at the fund level,” explains Dr. Norman Scherer, Managing Director of Emerald Advisory GmbH.

The Emerald Fund SCA SICAV-FIS (“Marshall Bridge Fund”) is managed at fund level by the responsible bodies. In this context, Xavier Deu, Managing Partner, and Paul Hunt, Chairman of the Investment Committee, are involved in the fund structure in a leading and responsible capacity.
